Draft: not legal advice
This is a starting template, not legal advice. Have it reviewed by a qualified solicitor before you rely on it.
These terms govern your use of BearWalk. By creating an account, starting a free trial or using the service, you agree to them. Please read them alongside our Privacy Policy and Cookie Policy.
1. Who we are
BearWalk ("BearWalk", "we", "us" or "our") provides business-management software for independent dog walkers in the United Kingdom. We are not a marketplace and we do not introduce clients to you. You own your client relationships; we simply give you the tools to run your walking business: recurring schedules, group walks, cancellation policies, automatic invoicing, payments and a client portal. We charge a flat subscription and take zero commission on your walks.
2. The service
BearWalk is a software-as-a-service product. We give you access to the platform; you are responsible for how you use it to run your own business. We may add, change or remove features to improve the service, and we aim to keep the platform available, but we do not guarantee uninterrupted or error-free operation.
3. Accounts and eligibility
You must be at least 18 years old and operating as a dog-walking business or sole trader to use BearWalk. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Tell us promptly if you believe your account has been compromised. You are responsible for the accuracy of the information you enter and for the actions of anyone you invite to your account, such as team members or fellow walkers.
4. Subscriptions, free trial and billing
BearWalk is offered on a subscription basis. New accounts start with a 14-day free trial with no card required up front. After the trial, continued use requires a paid subscription. Subscription fees are billed in advance through our payment processor, Stripe, on the plan and cycle you select. Prices are shown at sign-up and may change on renewal. We will give you reasonable notice of any change before it takes effect.
You can cancel your subscription at any time from within the app. When you cancel, you keep access until the end of your current paid period, and you will not be charged again. We do not provide pro-rata refunds for partial periods except where required by law.
5. Your clients, your data and your payments
You are the controller of the personal data you enter about your own clients and their pets, and you are responsible for handling that data lawfully, including having a proper basis to collect and store it and honouring your clients' rights. In respect of that client and pet data, BearWalk acts only as your processor, following your instructions, as described in our Privacy Policy.
Payments between you and your clients are made through your own Stripe account, which you connect to BearWalk. Those payments are between you and your client under your own terms. BearWalk is not a party to them, does not hold client funds, and is not responsible for the collection, refund or dispute of any payment you take from your clients. Your use of Stripe is also subject to their own terms.
6. Acceptable use
You agree not to misuse BearWalk. In particular, you must not use the service to break the law, infringe anyone's rights, send spam or unlawful marketing, upload malicious code, attempt to gain unauthorised access to our systems or other accounts, scrape or overload the platform, or resell the service without our written permission. We may investigate and take action, including suspension, where we reasonably believe these terms have been breached.
7. Intellectual property
BearWalk, its software, branding, design and content remain our property or that of our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service for your business while your subscription is active. You retain ownership of the data and content you put into BearWalk, and you grant us the limited licence we need to host and process it in order to provide the service.
8. Disclaimers and limitation of liability
BearWalk is provided "as is" and "as available". To the fullest extent permitted by law, we exclude implied warranties and we are not liable for indirect or consequential loss, loss of profit, loss of business or loss of data. Templates, guides and calculators provided in the app or on our website are practical starting points, not legal, tax or accounting advice. Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, or for fraud.
9. Suspension and termination
You may stop using BearWalk and close your account at any time. We may suspend or terminate your access if you breach these terms, if required by law, or if we discontinue the service, giving you reasonable notice where we can. On termination we will, for a limited period, make your data available for export before deleting it in line with our Privacy Policy.
10. Changes to these terms
We may update these terms from time to time. If we make a material change we will give you reasonable notice, for example by email or an in-app notice. Continuing to use BearWalk after a change takes effect means you accept the updated terms.
11. Governing law
These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
